What is Considered a Felony DWI in Louisiana?

In Louisiana, a DWI offense can become a felony under certain circumstances. Typically, DWI offenses are considered misdemeanors for first and second convictions. However, subsequent offenses or specific aggravating factors can elevate the charge to a felony.

The following are several examples of felony DWI offenses in Louisiana:

  • Third or Subsequent DWI Offense: If an individual has two or more previous DWI convictions and is arrested for another DWI offense, it can be charged as a felony, punishable by imprisonment for up to five years and a maximum fine of $2,000.
  • DWI with Serious Bodily Injury or Death: If DWI results in serious bodily injury or death to another person, the driver can be charged with a felony. DWI causing serious bodily injury carries a maximum prison term of five years and a fine of up to $2,000, while DWI causing death can result in imprisonment for up to 30 years and a maximum fine of $15,000.
  • Child Endangerment: If a person is arrested for DWI while a child under a certain age (typically 12 years old) is present in the vehicle, the offense can be charged as a felony. Louisiana has strict laws to protect children in such situations. Not only can you face DWI charges, but also a separate charge of child endangerment.
